About this policy

This Data Policy explains how we process personal data when you visit mittebuero.com, contact us, enquire about a project or venue booking, subscribe to our publications, interact with our social media presence, or otherwise work with Mitte Büro.

Personal data means any information relating to an identified or identifiable person. We process such data only where there is a legal basis to do so and only for as long as it is required for the relevant purpose or by law.

Website & hosting

This website is delivered using Cloudflare services. When you access the website, technical information required to establish and secure the connection may be processed automatically. This can include your IP address, date and time of access, requested URL, referrer information, browser and operating system information, and technical request or security data.

This processing is necessary to provide the website, maintain its stability and security, detect abusive or malicious traffic, and troubleshoot technical problems. The legal basis is Art. 6(1)(f) GDPR. Our legitimate interest is the secure, reliable and efficient operation of our website.

Cloudflare may process data outside the European Economic Area, including in the United States. Cloudflare states that international transfers are protected, where applicable, through the EU-U.S. Data Privacy Framework and the European Commission's Standard Contractual Clauses.

We do not use server-log information to create individual visitor profiles. Technical information is retained only for as long as required for operation, security and applicable legal obligations, subject also to the retention arrangements of our infrastructure providers.

Cookies & tracking

Mitte Büro currently does not use advertising trackers, Meta Pixel, behavioural profiling, third-party advertising cookies or non-essential analytics cookies on this website.

We therefore currently do not operate a cookie consent banner. Where storage on or access to your device is strictly necessary to provide a service expressly requested by you, it may take place without consent to the extent permitted by § 25(2) TDDDG.

If we introduce analytics, advertising technologies or other non-essential storage or tracking in the future, this policy will be updated and consent will be obtained where legally required.

Contact, projects & bookings

If you contact us by email or otherwise enquire about a collaboration, media partnership, creative project, production, event, venue booking or another service, we process the information you provide in order to respond to you and, where relevant, prepare or perform our agreement.

This may include your name, email address, telephone number, company or organisation, project details, correspondence, booking information, contractual information and billing details.

Where your enquiry concerns a possible or existing contract, the legal basis is Art. 6(1)(b) GDPR. For general business communications and communications with representatives of companies, the legal basis may also be Art. 6(1)(f) GDPR. Our legitimate interest is conducting and organising our business and responding to relevant enquiries.

Where processing is necessary to comply with tax, accounting or other legal obligations, the legal basis is Art. 6(1)(c) GDPR.

Mitte Monthly & Substack

Mitte Monthly is published using Substack. If you subscribe, Substack processes information required to manage and deliver the subscription. Depending on how you use Substack, this can include your email address, name or profile information, subscription status and engagement information such as email opens or link interactions.

We use subscriber information made available to us for the purpose of publishing and delivering Mitte Monthly and managing our relationship with subscribers. Newsletter delivery is based on your consent pursuant to Art. 6(1)(a) GDPR. You may withdraw that consent at any time by unsubscribing through the link included in newsletter emails.

Substack Inc. is based in the United States. Substack states that its Publisher Agreement includes Standard Contractual Clauses for transfers of personal data from the EU and UK to third countries.

Substack may additionally process information for its own platform purposes under its own privacy policy.

External links & social media

This website contains links to external services, including Instagram, Substack and other third-party websites connected to our editorial work, projects or collaborators.

A simple external link does not by itself transmit information to the linked provider. When you choose to follow such a link, you leave our website and the provider of the destination service may process personal data according to its own terms and privacy policy.

We currently do not embed Instagram tracking technology or Meta Pixel into this website.

If you communicate with us directly through a social media platform, we may process your profile information and the content of your communication in order to respond. The platform operator may independently process additional information about your use of its service.

Events, photography & video

Mitte Büro and Mitte Daily organise and document cultural, editorial and community events. At certain events, photographs, video or audio recordings may be produced for editorial documentation, communication, publication or promotion of our work.

Where identifiable people are recorded, the legal basis depends on the circumstances. Processing may be based on consent under Art. 6(1)(a) GDPR or on legitimate interests under Art. 6(1)(f) GDPR, including our interest in documenting and communicating our editorial, cultural and community activities. Additional rules governing the publication of images remain unaffected.

Where appropriate, more specific information about photography or recording will be provided in connection with the relevant event. If you have a concern about an image or recording in which you are identifiable, you can contact us at hello@mittedaily.com.

Who receives data

We disclose personal data only where this is necessary for the purposes described in this policy, where we are legally required to do so, or where you have authorised the disclosure.

Recipients may include hosting and infrastructure providers, email and communication providers, newsletter providers, accounting and tax service providers, professional advisers, production or event partners where necessary for a specific project, and public authorities where disclosure is required by law.

Where service providers process personal data on our behalf, we use appropriate data-processing arrangements where required by Art. 28 GDPR.

How long we keep data

We retain personal data only for as long as it is necessary for the purpose for which it was collected, or for as long as statutory retention requirements, legal claims or other legitimate reasons require.

Enquiries that do not result in a contractual relationship are generally deleted when they are no longer required for the enquiry and any reasonable follow-up. Contractual and project records may be retained for the duration of the contractual relationship and applicable limitation periods.

Where documents are subject to German tax or commercial-law retention obligations, they are kept for the applicable statutory period. This can include eight years for booking documents and six years for certain business correspondence.

Newsletter subscriber information is retained until you unsubscribe or otherwise withdraw your consent, subject to limited further retention where needed to document compliance with legal obligations.

Your rights

Subject to the conditions of the GDPR, you have the right to request access to personal data concerning you, correction of inaccurate data, deletion, restriction of processing and data portability.

Where processing is based on your consent, you may withdraw that consent at any time with effect for the future. The lawfulness of processing carried out before withdrawal is not affected.

Where we process personal data on the basis of legitimate interests under Art. 6(1)(f) GDPR, you also have the right to object to that processing in accordance with Art. 21 GDPR.
